Refund and Cancellation:

EKASO-TAKA is obligated to keep confidential and private a client. In accordance therewith, EKASO-TAKA takes reasonable precautions to keep personal information gathered by EKASO-TAKA from misuse and loss and unauthorized access, modification, or disclosure. EKASO-TAKA can use and disclose the personal information of the client (and, where necessary, of the client’s family) for the main reason why it was obtained, for the reasonably expected secondary purposes directly related to the main purpose, and in other situations as approved under the Privacy Act. As a general rule, EKASO-TAKA will release the personal information of the client for the following purposes:

  • To conduct our business,
  • To provide and market our services,
  • To communicate with the client,
  • To comply with our legal obligations, and
  • To help us manage and improve our services.

EKASO-TAKA will not, under any circumstances, issue refunds for early service withdrawal.

  1. The percentages of refund referred to are for the entire full-service fee paid and not just for the amount paid. Refund percentages would be applicable only if the total fee of the product is paid without any remaining balance. Clients would not qualify for the refund percentage even if they belong to one of the referred clauses or if they haven’t paid the entire full-service fee referred.
  2. The immigration announcements are sometimes reduced based on expectation and clients are booked in advance, i.e., prior to the announcement of actual qualification to ensure that the cap system is fulfilled. It’s agreed in advance that the client does take notice of this and is willing to do so to avoid last-minute rush and prepare according to all requirements well before the announcement by the immigration authorities. In case the profile of the client is not selected after the announcement, client may opt to shift to other prospects.
  3. EKASO-TAKA maintains a zero-tolerance approach to charge backs. Any client who complains about a credit card payment found to be legitimate will be permanently blacklisted and prohibited from utilizing the service. Any overdue fees and charges will be referred to collections. Should our collection efforts be unsuccessful, outstanding debts will be reported to all Credit Reporting Agencies available.
  4. The client acknowledges and agrees that the entire bill value (invoice amount) will consist of the EKASO-TAKA consultation fee and the amount of tax applicable. The refund, however, would be based only on the EKASO-TAKA consultation fee. The tax amount is non-refundable at any point in time.
  5. Upon rejection by the Immigration Authorities, EKASO-TAKA will refund the amount as indicated in the agreement. The refund will be done within 15-30 working days from the date the client submits the Online Refund Claim Form to EKASO-TAKA. The client must include a copy of the letter of rejection from the Authority to accompany the Refund Claim. If a client does not enclose a copy of the rejection letter or rejection stamp on the client’s passport, EKASO-TAKA will not be in a position to provide a refund.
  6. The company is not responsible for any delay caused by third-party services. Also, clients cannot claim a refund of service charges.
  7. EKASO-TAKA is not liable for refund of any fee or other amounts/charges already paid to any Assessing Bodies, Immigration Authorities, Embassy/Consulate/High Commission in case the client fails to obtain immigration approval, or on account of his/her application being rejected or refused at any stage by any concerned authority. The charges only includes the charges in respect of services rendered by EKASO-TAKA without any request or assessing fees. The client hereby agrees to remit the additional charges in whole, as per applicability.
  8. In the event that the money has already been paid by the client via an online card facility, the client hereby authorizes that he/she will not charge back, or is not liable to draw back the amount without the information of EKASO-TAKA, if the payment is made by any medium. This shall exclude CC Avenue unless otherwise as per the norms of refund as stated in the agreement and the process as laid down by law in force at that time under the Jurisdiction of Hyderabad, State of Telangana.
  9. If the client has made the payment by Credit Card or Net Banking, he will voluntarily undertake that he will not contest the payment or inform the concerned bank for chargeback, demanding that the bank hold back or reverse the payment made to EKASO-TAKA by him. The client also undertakes to advise his banker that the payment given to EKASO-TAKA is authentic and the transaction is an exception to his request to chargeback or cancel the payment in his interest. This encompasses misuse and card loss situations either on his behalf or through anybody else. The client undertakes to collaborate with EKASO-TAKA in this regard in the event that EKASO-TAKA wants to defend/represent the case in their own interest before any bank/authority.
  10. The EKASO-TAKA’s Service Charges have no relation to the market charges and are according to the company standards to which the client has consented. Any post-registration claims such as charges are too costly and so on would not be considered and the client would not be eligible to dispute the same since it was explained and communicated by all means of information, and the client has been notified prior to registration.
  11. The client agrees that immigration involves demonstrating sufficient funds, if required, which varies from nation to nation and the route/category the client is applying. The client agrees to fulfill such requirement as desired by the concerned immigration/other authorities, and non-provision of such funds by the client shall not render EKASO-TAKA liable for any refund of the service charges or part thereof. In such instances, no request for refund of service charges will be entertained.
  12. The customer also agrees that all/any registrations for any nation prior to this customer declaration agreement date, if any, with EKASO-TAKA would be canceled and no claim of the service or the fee can be made until it is provided in writing by EKASO-TAKA.
  13. In case of the permit being rejected on the following grounds no refund will be made –
    • If the client fails to attend the interview.
    • Failure of medicals by the client or his or her family members included in the request.
    • If the client does not comply with the requirements of the Embassy or the Consulate.
    • Failure to provide a genuine Police Clearance Certificate, which is not less than 3 months old
    • Failure to prove sufficient funds for settlement by the client or his or her family members.
    • Prior violation of any immigration law by the client or any of his or her family members.
    • Late submission of any additional papers requested by the consulate at a later date
    • The client fails to get the required score in English language test to meet the eligibility criteria and as advised by the EKASO-TAKA consultant.
    • There would be no refund if the client abandons his/her case within 3 months from the date of registration
    • Non-communication with your Consultant for a period of 3 months shall also be deemed to be abandonment
  14. The charge paid to authorities or any other institution is the responsibility of the client and is not covered by the service charges. EKASO-TAKA will not accept any claim for refund in case of rejection.
  15. The client shall provide, within 30 days, every and all paper, forms, and facts that will enable EKASO-TAKA to work on his/her request and prepare it submit-ready prior to the relevant assessing/immigration authority. The client’s failure to do the same will only indicate that no refund of the advisory/consulting fee provided to EKASO-TAKA is due.
  16. The client must inform EKASO-TAKA of every and every communication received by him/her from the office – written or on the phone – within a week of receiving such a message. Apart from that, the client shall inform the said immigration consultancy of every single communication (either written or by phone) that the client makes, directly with the concerned bureau within a week or 7 days of having such a contact. This includes personal visits to the office, and/or phone inquiry made. The client’s failure to do the same will only indicate that no money back at all is due of any secretarial charges made available to EKASO-TAKA.
  17. The client shall attend every and any interview, as and when required by the said agency, at the location indicated by the agency, and at his own expense, and promptly execute every and any necessary order as directed by the agency. The client’s failure to do so will only imply that no refund whatever is due of any secretarial fees provided to EKASO-TAKA.
  18. In case the request/petition is returned/rejected/delayed owing to a mistake in the request fee or payment mode, the client acknowledges that he shall not dispute on withdrawal of his request on this basis; since the payment and the mode of payment of request fee is the sole responsibility of the client.
  19. It is realized that filing of a request for immigration is never time bound, routine and/or general. The related case officer could demand more papers, according to the evolving requirements of the procedure, and ask for further submission of such more papers to the related immigration authorities. Any application for the refund on these accounts will not be accepted.
  20. The client must also comprehend and agree that no refund or transfer of EKASO-TAKA fee to his/her friend or relative will be made in the case he or she cancels his/her request or opts out due to any cause during proceedings after signing-up.
  21. The client shall provide all necessary information and documents, including the English translations, in a form agreed upon as desired by EKASO-TAKA and the concerned office. It has been completely agreed by the said immigration consultancy based on the facts and documents brought forward by the client. In the event that the provided information is found to be false or fabricated or lacking or wrong, the offer will not be considered by the respective Immigration authorities. Further, the immigration consultancy does not assume any responsibility whatsoever for adverse effect on the outcome of the petition and the resulting rejection on this ground. No refund will be made, either of the consulting fee or the amount received by the government agencies, in such cases.
  22. EKASO-TAKA has the right to terminate/withdraw their services without refund of service fee of the client on below terms.
    • If the client does not submit all papers within the stipulated time from the date of his/her registration which is normally within one month
    • Tries to malign the name of the company in whatsoever manner, which tampers the functioning of the business or reputation
    • Doesn’t respond to the mails and calls made by the company for more than a month and backs out due to personal reasons
    • EKASO-TAKA reasonably forms the view that someone other than the client is attempting to gain access to the Service for his or her personal benefit.
    • At the discretion of EKASO-TAKA, you behave in such a way that renders your consultant unable to provide the service(s) any longer.
  23. The client here undertakes to fulfill all the needs of the concerned authorities who evaluate or determine the outcome. The client undertakes to provide all the documents with originals if needed by the concerned evaluating authorities. The client is aware that any default on his/her part to produce these papers or part thereof is an independent default of client and EKASO-TAKA is in no manner responsible for the same. Therefore, the client confirms that failure to produce papers cannot be a reasonable ground to claim a refund.
  24. The client will pay all fees that may be due to a number of government and skills assessment authorities and language test organizations like but not limited to the skills assessment fees, petition fees for residency permit, the Acceptable English language or other language tests if necessary, health tests, etc. The provided charges are strictly non-refundable and unadjustable by either any of the receiving offices or the immigration consultancy, despite the ultimate conclusion on the petition. A positive appraisal or conclusion is the only prerogative of the concerned organization, even while the immigration consultancy has no control whatsoever over the ultimate outcome at any stage of the petition. EKASO-TAKA has made no promise whatever of a successful appraisal or outcome of the client’s anticipated petition in any stage.
  25. The client will notify EKASO-TAKA of all news regarding a change of housing/mailing address, educational/specialized credentials, change of matrimonial status/service or company, newly born children or any police/unlawful case subsequent to the filing of the petition and during the course of the proceeding until the time of discharge of Permanent Residence Permit. The failure of the client to do the same will only reflect that no refund whatsoever is due of any advisory fees provided to the immigration consultancy.
  26. The client will report for an Acceptable English language or other language test as applicable and score not less than a group individual minimum total in each specified four aspects of appraisal factors – Listening, Reading, Writing, and Speaking – as are applicable to him/her and in accordance with the need of the issuing authority/assessing body. The client fully understands and agrees that his application cannot be lodged unless he has the required Acceptable English language or other language tests (if relevant), including partner or dependents over 18 years, and no refund of the advisory/consulting/secretarial services fee provided to EKASO-TAKA will be pending or paid in a case where he does not achieve the needed Acceptable English language or other language test.
  27. The client will also ensure that he/she is married or in any relationship which is acceptable to be accepted as dependent–spouse or the acceptable dependent/s appears for an Acceptable English language or other language test if required and provides a report with minimum score as is suitable on the basis of the agreed SERVICE LEVEL AGREEMENT with EKASO-TAKA.
  28. By signing/acknowledging our contract to use our services, the client cannot withdraw AT ANY TIME during the process due to their own personal circumstances which may have altered. It is not acceptable to entertain or consider any settlement. Since we are a business of heavy investment, we cannot accept requests for refunds after services have been rendered or when any portion of the process has begun.
  29. The client shall faithfully disclose prior to EKASO-TAKA – all the details pertaining to all the existing or previous cases of wrong-doings and/or conviction and insolvency brought against the clients and those who are reliant upon him. If he fails to disclose such information, and if the same is discovered subsequently, no refunds whatsoever of the money paid to EKASO-TAKA in question will be provided.
  30. EKASO-TAKA is obligated to keep confidential and private a client. To that end, EKASO-TAKA takes reasonable precautions to ensure personal information obtained by EKASO-TAKA is not misused and lost and is not accessed, modified, or disclosed on an unauthorized basis. EKASO-TAKA can use and disclose the client’s (and, if necessary, the client’s family’s) personal information for the main purpose for which it is gathered, for reasonably anticipated secondary purposes that are connected to the main purpose, and in other situations as approved by the Privacy Act. Generally, EKASO-TAKA will disclose the client’s personal information for the following reasons:
  • To conduct our business,
  • To provide and market our services,
  • To communicate with the client,
  • To comply with our legal obligations, and
  • To help us manage and improve our services.

EKASO-TAKA issues receipts for all payments collected; however, it is crucial to note that the company is not responsible for any payments made directly.

  • The client expressly agrees that he has been informed of the normal waiting periods/average time, as per his permit class, and additionally that such waiting periods/normal time exclusively lies in the office/appraisal body concerned’s convenience. The client also comprehensively agrees and understands that he will never have any claims of any kind on any type of refund of the fee paid on or off-site on account of the lengthy petition time frames.
  • EKASO-TAKA has never provided any form of guarantee, advice or vow on employment or job guarantee after an approval of the permit and upon arrival in any overseas nation. No compensation will be recovered of any advisory/consulting/secretarial service fees provided previously to EKASO-TAKA by the client on the basis that EKASO-TAKA has failed to provide a guarantee of employment abroad.
  • In a scenario where there is a conflict/dispute in the issue of payment made by a client to EKASO-TAKA in respect of the SERVICE LEVEL AGREEMENT signed under duress with EKASO-TAKA. The onus of EKASO-TAKA, in the event that it arises and is due, either financial or otherwise, shall not exceed and will be limited to the fees provided to EKASO-TAKA as advisor/consulting/secretarial fees as part of the duly signed SERVICE LEVEL AGREEMENT.
  • There are some nations that are under a cap system, and therefore, the grant of Green Card/Permanent Residence depends upon the cap not being filled up for that particular year. The client can have the necessary points as required by the immigration department of the particular nation, but he/she still might not receive the Green Card/Permanent Residence if the cap has been filled up for the particular year. Not obtaining a Green Card/Permanent Residence due to the cap limit cannot be grounds for requesting a refund, and the client well understands the same.
  • If your request for a refund falls under the acceptable terms and conditions of the Company and the service agreement, the time taken for such a request would be 15-30 working days.
  • The written service amount is for the whole service as of the date of registration, and only encompasses one’s request. Any presumption of additional services to family or kids is at the client’s option, and the company will not be held accountable for these types of presumptions.
  • The client will faithfully disclose prior to EKASO-TAKA – each and every information concerning each and every present or past, case of misconduct and/or conviction, and insolvency charged against the clients and those who are reliant on him. In the event he fails to disclose such information, and in the event the same is discovered subsequently, refunds in full of the money provided to EKASO-TAKA in question shall not be made.

Any payment of fees to EKASO-TAKA is for the delivery of services as per EKASO-TAKA website. Except as otherwise noted, all fees are in Indian Rupees. You agree to pay all fees and applicable taxes for our services using one of our accepted forms of payment.

EKASO-TAKA is not affiliated with any government authority/organization or embassy. We are a Private Limited company and we have no right to issue you a permit of any sort. We can only guide, advise and assist individuals who wish to migrate or travel to their chosen country. Kindly note that the final decision on all applications lies with the concerned government departments in their respective countries.

Our agreements with clients are drawn on the bedrock of trust, sincerity, and security, and each option is spelled out clearly. Our terms are transparent and there is nothing hidden.

The client confirms and understands that the company never implies or coerces any service/product etc. and the declaration of a specific service/product etc. is the client’s personal choice and cannot ever be presumed to be a company decision.

EKASO-TAKA markets all the products and educates all clients about the opportunities without any external pressure to have decided on this service/product etc.

The client has noticed all the above provisions in detail, agrees, and continues to adhere to all the terms and conditions of signing/acknowledging this agreement.

EKASO-TAKA is controlled and managed in India with its registered office at Hyderabad, Telangana. The Government of India laws and the State Government of Telangana laws will apply to the validity, interpretation, and performance of this Agreement. The courts at Hyderabad, Telangana alone shall have jurisdiction to adjudicate any dispute between the company and any individual arising out of any matter relating to the company.

Force Majeure. In no case shall the Company be held liable or responsible for any delay or failure in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation – strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, any outbreaks, Epidemics or Pandemics; and interruption, loss or malfunction of utilities, communications or computer (software and hardware) services. It is believed that the company will make all reasonable efforts to restore service at the earliest under the circumstances. Your file will be withheld /deferred till the situations come under control. In case we found you to be ineligible to apply, service fee paid no refund will be due as the service has already been initiated.

Charge Back: It is mutually agreed that the client is aware that EKASO-TAKA will send its employees and use other facilities for offering services to the client by incurring substantial amounts of money. Regardless of the outcome of the request, the client hereunder promises that he shall not seek a refund of the fees and charges incurred to EKASO-TAKA, except as given in the agreement.

The client agree and understands the outputs of the service subscribed to, and thus will not make a chargeback (only for Card Payments).
